08/26/08 Bend

During the third day of the carjacking trial, a verdict is reached. 26 year old Kevin Allan Couch was found guilty on all counts of robbery, coercion, and unlawful use of a weapon and vehichle. Both the prosecution and defense made their closing arguments, and the verdict was reached within hours.

Before closing arguments began, Judge Stephen Forte briefed the judges. "It is your sole responsibility to make all the decisions about the facts in this case," he said.

26 year old Kevin Couch is accused of car jacking a woman and her child at knife point in the Costco parking lot on a February afternoon. Couch pleaded not guilty to the accusations last week at the start of the trial-- and at Tuesdays closing arguments, the prosecution recapped their evidence. "the way those fingerprints are located, they are consistant with the door being opened and that's significant," said Prosecutor Beth Bagley.

And present Couch's exact statements. "The thing at Costco, I did it, he admitted it, he admitted it to his mom," said Bagley.

And Couch listened, shaking his head in disagreement before the defense took the floor. Couch's attorney worked to discredit the prosecutions evidence. "we have testimony about a knife, but that hangs in the air doesn't it? it's like it's stuck on a tree and still going boong boong boong. But there's no connection to that knife to mr. Couch," said Defense Attorney Jaques Dekalb.

Also making points to poke holes in the State's case. Pointing out there was no clear description of the suspects clothes, and no identification of his voice. The jury deliberated for about two hours before handing down a guilty verdict. Kevin Couch will be back in court Wednesday morning when the judge will set a date for his sentencing.
